Kentucky Abandoned Mine Land (AML) Projects

Under the authority of Title IV of the Surface Mining Control and Reclamation Act of 1977 (SMCRA), the Office of Surface Mining, Reclamation and Enforcement (OSMRE) provides Kentucky with federal financial assistance through annual construction grants for Abandoned Mine Land (AML) projects to reclaim and restore land and water resources adversely affected by eligible coal mining operations. Kentucky submits project proposals to OSMRE throughout the year for OSMRE "authorization to proceed with construction activity" (ATP), after which Kentucky may begin construction contracting and accomplish actual reclamation work to remedy an AML problem.

The construction activities of these federal funding actions are required to be evaluated for environmental impacts under the National Environmental Policy Act of 1969 (NEPA). NEPA requires that the environmental evaluation be recorded in a decision document. The NEPA environmental reviews of AML projects are documented in either (1) an Environmental Assessment (EA) with a Finding of No Significant Impact (FONSI) or (2) a Categorical Exclusion Certification and Determination (CX), as prescribed in NEPA, the US DOI Departmental Manual, and OSMRE directives and guidelines.

Public Notice of NEPA Environmental Review

NEPA requires that EA/FONSI's and CX's for AML reclamation projects be made available to the public and that the public be notified when and where they are available for public information. The complete files for AML reclamation projects in Kentucky, to include NEPA documents, are available for public review at:

To comply with NEPA notification provisions and for the convenience of the public, the NEPA determination documents for projects in Kentucky authorized after January 1, 2011, are also available in PDF file format on this web site. The PDF file will be posted on this site as soon as possible after OSMRE completes the NEPA document. The PDF document files are organized by calendar year. The PDF file name includes the year authorized, project name, then the primary county in which the project is located.
