Charleston Field Office (CHFO)

Responsibilities

The Charleston Field Office (CHFO) is responsible for the oversight of the West Virginia and Virginia coal regulatory and abandoned mine land programs to ensure that surface coal mining operations, which includes the surface effects of underground coal mining operations and the reclamation of abandoned mine lands (mining operations conducted prior to August 3, 1977), are conducted in accordance with the Surface Mining Control and Reclamation Act of 1977 (SMRCA).

The West Virginia Department of Environmental Protection (WVDEP) is the regulatory authority for the surface coal mining regulatory program and also the designated agency for the abandoned mine land reclamation program. The Division of Mining & Reclamation is responsible for the administration and enforcement of the regulatory program and the Office of Abandoned Mine Lands and Reclamation conducts all abandoned mine land reclamation which includes non-emergency, emergency, water supply and acid mine drainage set aside.

As delegated by the United States Secretary of the Interior, the Virginia Department of Mines, Minerals and Energy (DMME); Division of Mined Land Reclamation is the regulatory authority for the coal surface mining regulatory and abandoned mine land reclamation programs in the Commonwealth of Virginia.

The Area Offices, residing in Big Stone Gap, VA and Beckley, WV, maintain oversight responsibility for the Virginia and West Virginia coal regulatory and abandoned mine land programs under the delegation process.

OSM offers funding to non-profit watershed organizations to complete local acid mine drainage (AMD) remediation projects through the Watershed Cooperative Agreement Program (WCAP). For additional information, contact Jenna Hincks at jhincks@osmre.gov.

Oversight Summary

Oversight plans intended to measure the State's success in meeting the environmental protection goals of SMCRA for both the regulatory and abandoned mine lands programs have been cooperatively developed by CHFO, WVDEP and DMME. The plans, also known as performance agreements, identify the oversight topics to be reviewed and describe how oversight will be conducted. These documents may be updated or modified at any time to meet changing needs and conditions. The current Regulatory Performance Agreement, Inspection Agreement and AML Performance Agreement are available within the Office of Surface Mining Reclamation and Enforcement's (OSMRE) Reg-8 Oversight Database (ODocs) or printed copies are available from the office on request.

Annual evaluation reports of the Regulatory and AML programs are prepared based upon the oversight plans. These are also available at OSMRE's Reg-8 Oversight Database (ODocs).

Comments regarding performance agreements, annual reports or other concerns are always welcomed and may be submitted by email to the general office address or by regular mail to the address below.


Outreach for Oversight

When a Performance Agreement is due for revision and renewal, OSM will be soliciting comments and suggestions from citizens, environmental groups, industry and other interested parties regarding oversight and potential oversight review topics between March 1 and March 15.

Additionally, between May 1 and May 15, OSM will offer the opportunity for interested parties to comment on the proposed draft Performance Agreement. Interested parties are always welcome to engage in discussions with the field office regarding oversight, oversight topics, and Performance Agreements. Comments may be submitted via email or mail to the contact information listed below. All Proposed Oversight Performance Agreements, draft and final, can be found in the Reg-8 Oversight Database (ODocs), by searching by State and ‘Annual Performance Agreement.’

Final Performance Agreements will be completed by June 30 and will be available by July 14 in ODocs. You may also request a hard copy of the document. Thank you for your participation in this important process.
